    WHEREAS, LB Enterprise LLC, a Missouri Limited Liability Company, by its certain Deed of Trust dated the 24th day of April, 2015, and recorded in the Recorder’s Office of Miller County, State of Missouri, recorded on the 29th day of April, 2015, at Deed of Trust Book 2015, Page 1740 conveyed to John E. Curran, as Trustee, all of its right, title, interest and estate in and to the following described real estate, County of Miller, State of Missouri, viz:
    All of Lot No. 12 of “BLUE LODGE ESTATES,” a subdivision in Miller County, Missouri, according to the plat thereof on file and of record in the Miller County Recorder’s Office.

    All real property lying South of a conditional line described as follows:
    A conditional line located upon a tract of land being a part of the Northwest Quarter of the Southeast Quarter of Section Ten (10), Township Forty (40) North, Range Sixteen (16) West, Miller County, Missouri, said conditional line being more particularly described as follows:
    Beginning at a flintstone at the Southeast corner of said Section Ten (10), thence North 47 degrees 53 minutes 13 seconds West, 2885.09 feet, to a point on the centerline of a road, as shown on the plat of BLUE LODGE ESTATES, for the true point of beginning of said conditional line; thence leaving said centerline, South 70 degrees 53 minutes 41 seconds West, 208.90 feet, to the variable water’s edge of the Lake of the Ozarks for the termination of said conditional line.

    A tract of a land being a part of the Northwest Quarter of the Southeast Quarter of Section Ten (10), Township Forty (40) North, Range Sixteen (16) West, Miller County, Missouri, more particularly described as follows:
    Beginning at a flintstone at the Southeast corner of said Section Ten (10), thence North 47 degrees 53 minutes 13 seconds West, 2885.09 feet, to a point on the centerline of a road, as shown on the plat of BLUE LODGE ESTATES, for the true point of beginning; thence leaving said centerline, South 70 degrees 53 minutes 41 seconds West, 208.90 feet, to a point near the shoreline of the Lake of the Ozarks; thence North 09 degrees 59 minutes 35 seconds West, along said shoreline, 97.27 feet; thence leaving said shoreline, North 77 degrees 35 minutes 46 seconds East, 60.92 feet; thence North 83 degrees 31 minutes 14 seconds West, 128.16 feet to the centerline of said road; thence South 26 degrees 31 minutes 21 seconds East, along said centerline, 61.43 feet to the true point of beginning.
    Also additional property secured by this Deed of Trust as described as “The covered boat dock with encapsulated foam and two 10 x 28 steel boat slips, 8 x 28 swim platform and 40 ft boat ramp located at 50 North Shore Resort Road, Eldon, MO 65026, together with all proceeds thereof, shall be deemed as part of the property and shall further secure the obligations under the note, this Deed of Trust and the related documents.”
    Which said conveyance was made in trust to secure the payment of a certain promissory note in said deed described, and,
    WHEREAS, said note has become due and is now unpaid, and
    WHEREAS, said Trustee has refused to act and said Deed of Trust provides that the holder of said note may appoint by written instrument filed of record in the Miller County Recorder’s Office another Trustee in place and stead of the Trustee named therein, and thereupon, the Trustee therein named shall be discharged and the Trustee so appointed shall be substituted as Trustee hereunder with the same effect as if originally named Trustee therein; and
    WHEREAS, the holder of said note has appointed Derek L. Smith of Camden County, Missouri as the Substitute Trustee therein by written instrument, filed of record with the Miller County Recorder of Deeds;
    NOW THEREFORE, in accordance with the provisions of said Deed of Trust, and at the request of the owners and holders of said Deed of Trust and beneficiary of said indebtedness, the undersigned Substitute Trustee will proceed to sell the above described real estate at the front door of the County Courthouse, in the City of Tuscumbia, in the County of Miller, State aforesaid, to the highest bidder, for cash, at public auction on Monday, the 22nd day of July, 2019, between the hours of nine in the forenoon and five in the afternoon of the day, towit: at approximately 1:00 p.m., to satisfy said note, together with the cost and expenses of executing this trust.
